The Legal Landscape of Sportsbooks in Tennessee
Prior to May 2018, the U.S. sports betting industry was essentially shut down. The Professional and Amateur Sports Protect Act (PASPA), a law passed in 1992 to outlaw sports betting, meant only Nevada could legally operate sportsbooks. The U.S. Supreme Court agreed to overturn PASPA in 2018, giving every state the ability to legalize this form of gambling.
Proponents of sports betting in Tennessee immediately drafted legislation to allow sportsbooks in the state. Lawmakers here were torn, including Governor Bill Lee, who publically stated his disapproval of the sports gambling industry. Despite the pushback, a bill to legalize sports betting in Tennessee called HB 0001 (sometimes called the Tennessee Sports Gaming Act) was approved in May 2019. Governor Lee allowed the measure to pass without his signature.
Only online sportsbooks can legally operate in the state. These online betting companies must pay an initial application fee of $50,000 for a license to operate. If approved, they must then pay an annual fee of $750,000.
Since launching in 2020, all Tennessee sports betting apps have been taxed at 20% of their gross gaming revenue. In mid-2023, a new bill called SB 475 was presented to the Senate that would begin taxing these betting operators on 1.85% of their handle, rather than revenue. The bill was passed by a 30-0 margin in the Senate and was quickly approved in the House. On May 26, 2023, Governor Lee formally signed this bill into law.
Tennessee continues to benefit from its legal sports betting operations. The state regularly reports a monthly betting handle of over $300 million and millions of dollars in tax revenue have gone to fund various social projects.
